At The Studio Killcare, we aim to provide beautiful, professional photography with care, creativity, and consistency. Our 100% Satisfaction Guarantee applies to all prepaid Photo Day Packages and outlines what's covered.

Satisfaction Guarantee

Covered:

• Fewer than 2 individual images per child

• Image quality not meeting professional standards (exposure, resolution)

• Child unwell or absent (not on holidays)

• Portraits where children are visibly distressed

Not Covered:

• Unwillingness to participate

• Absence from group/class photos

• Not looking at camera in group photos

• Minor variations in pose or expression

• Sibling packs with similar poses

• Prepaid bookings while knowingly away

• High-quality sets with <4 images

Next Steps:
Contact us within 7 days of receiving your images. If eligible, we’ll arrange a reshoot at our Killcare studio. If scheduling isn’t possible, a full refund will be issued. Images from the original session will be deleted and replaced entirely by the reshoot.

Pop-Up & Community Sessions

We occasionally offer sessions in public spaces (e.g., parks, community events), sometimes as fundraisers.

• Bookings are prepaid, one session per child/family

• Managed via secure third-party platforms

• No data is stored on these platforms

• We may cancel/refund sessions due to safety, conduct, or unforeseen issues

Health & Safety

All photographers are fully trained, hold Working With Children Checks, and comply with NSW Health guidelines. We reserve the right to decline participation in any session for safety or wellbeing concerns.

Privacy Policy

We respect your privacy and only collect essential personal info: names, contact details, child’s name/class. Data is collected via direct contact or with consent through childcare centres or booking platforms.

Use & Disclosure:

• Used only for service delivery and customer support

• Never sold or shared without permission

• May be disclosed if required by law or public safety

• Images are deleted within 3 months of the session

Image Usage:
We will not use images for marketing, website, or social media unless a signed Media Consent Form is provided. Private viewing galleries are secure and accessible only to authorised families.

Marketing Communication:
We may email session info or promotions. You can opt out anytime.

Copyright & Intellectual Property

All content and images by The Studio Killcare are protected by copyright. You may view/download personal galleries but may not reuse or distribute content for commercial purposes. Use of our name, branding, or logo without written permission is prohibited.

Website System & Security

Occasional maintenance or downtime may affect availability. Data is backed up regularly. We are not responsible for data loss caused by outages or user error.

We use physical and digital safeguards to protect your data, but we encourage all users to practice good online security (e.g. don’t share access links).

Disclaimer & Limitation of Liability

We do our best to provide reliable information and service, but disclaim liability for:

• Errors or omissions on our site

• Interruptions to service

• Technical failures or data loss

• Incompatibility with user needs or equipment

You agree to use our services and website at your own risk. These terms do not affect your rights under Australian Consumer Law.

General

These Terms are governed by NSW law. If any part is found unenforceable, it won’t affect the rest. No agency, partnership, or employment relationship is created by these Terms.

Purpose of Consent: The Studio Killcare captures class and team photographs that include multiple children. These images are made available in digital format to families within the same educational or team group. Privacy and Confidentiality: The Studio Killcare is committed to protecting your child's personal information. All images are stored securely and access is limited to authorized personnel. We will not use these photographs for any purposes other than those specified without your explicit consent.​

Withdrawal of Consent: You have the right to withdraw your consent at any time by contacting The Studio Killcare. Upon withdrawal, we will cease to include your child in group photographs intended for digital distribution.​
